What is Development Variance Permit No. 641-38 (DVP641-38)?

The subject property is located at 891 McBeath Road in Nicholson of Electoral Area A and is more particularly shown on the location map in the attached notice. 

The subject property is a mobile home park; the owner has made an application for a 25 year lease agreement so that he may sell the subject property but continue to live in one of the mobile homes located on the property. In accordance with Part 73 of the Land Title Act, a lease agreement that exceeds a 3 year term is considered a subdivision and therefore the requirements of Subdivision Servicing Bylaw No. 641 (Bylaw No. 641) apply.

The proposed 0.155 ha lease area is smaller than the 1 ha minimum parcel size requirement of Bylaw No. 641; all properties to be subdivided for single family residential use proposed to be serviced with an on-site sewage disposal system and an independent on-site water system must be a minimum of 1.0 ha. As this subdivision proposal is less than 1 ha, a DVP application is required to vary the minimum parcel size requirement of Bylaw No. 641. The applicant has also requested a variance to waive the requirements for proving on-site sewage disposal and on-site water systems that meets the requirements of Bylaw No. 641.

Due to emergency provisions now in place for the COVID-19 pandemic, copies of the proposed permit application and relevant background documents will only be available by email request to plan@csrd.bc.ca beginning Thursday, June 4, 2020 and ending Thursday, June 18, 2020.

How do I send a written submission about this permit application?

Written submissions will be accepted at the CSRD office, 555 Harbourfront Drive NE, Salmon Arm, BC, until 4:00 PM on Tuesday, June 16, 2020.  The Board of the CSRD considers the author's name and residential address relevant to the Board's consideration of this matter and should be included in your submission. The author's phone number and email address are not relevant to the Board’s consideration of this matter and should not be included in the written submission. Written submissions received by the CSRD are subject to public disclosure and a copy may be provided to the applicant. Please clearly write "DVP Submission – DVP641-38" on your submission. Where and when will the permit be considered for issuance?

At the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 AM on Thursday, June 18, 2020. 

Due to special provisions regarding COVID-19, the June 18, 2020 CSRD Board meeting will be taking place through the use of remote communications technology and the public will be able to be present with strict provisions.
