[ARCHIVED] Notice of Bylaw Amendment & Waiving of Public Hearing: Scotch Creek/Lee Creek Amendment Bylaw 825-47

What is Scotch Creek/Lee Creek Amendment Bylaw Number 825-47 (BL825-47)?

The subject property is located at 1343 Deodar Road in Scotch Creek of Electoral Area F and is more particularly shown in bold outline on the map:

The property owners are proposing to build a new 190 m2 accessory building with a secondary dwelling unit on the upper floor. The R1 - Residential zoning currently permits one single family dwelling and maximum floor area for an accessory building of 75 m2. It is proposed to add a site specific regulation to the R1 zone in Bylaw Number 825 to permit a 53.6 m2 dwelling unit on the upper floor of the 190 m2 accessory building.

Waiving of Public Hearing

This bylaw amendment proposal is consistent with the policies contained in Electoral Area F Official Community Plan Bylaw Number 830. The property is designated Neighbourhood Residential (NR) which supports the proposed density and housing form. Therefore, there are no amendments required to the Official Community Plan.

Section 464(2) of the Local Government Act provides an option for local governments to waive the holding of a public hearing with respect to a bylaw amendment, if there is an Official Community Plan (OCP) in effect for the area that is subject to the zoning bylaw, and the proposed bylaw amendment is consistent with the OCP. As this bylaw amendment is consistent with the OCP, the Board waived the holding of a public hearing for this bylaw amendment at its November 18, 2021 Board meeting.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw Number 4001, all owners of property within 100 m of the subject property must be sent notices advising that a public hearing has been waived and be given the opportunity to provide comment about the bylaw amendment.

How Do I Send a Written Submission?

Written submissions will be accepted at the CSRD office, 555 Harbourfront Drive NE, Salmon Arm, BC, until 4 pm on Tuesday, January 18, 2022. The Board of the CSRD considers the author's name and residential address relevant to the Board's consideration of this matter and should be included in your submission. The author's phone number and email address are not relevant to the Board's consideration of this matter and should not be included in the written submission.

Written submissions received by the CSRD are subject to public disclosure and a copy may be provided to the applicant. Written submissions may be submitted by email or to the address listed previously. Please clearly write "Bylaw Amendment Submission - BL825-47" on your submission.

Where and When Will the Application Be Considered by the Board?

At the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 am on Thursday, January 20, 2022.

Public attendance is permitted at the meeting subject to special COVID-19 provisions, including a maximum capacity limit in the Boardroom and mandatory mask requirements. Alternatively, the public may join the meeting electronically via Zoom. There is no specific opportunity for the public to provide verbal or written submissions about this application at this meeting.
