What is Lakes Zoning Amendment Bylaw Number 900-28 (BL900-28)?

The subject property, 673 Swanbeach Road, is located in Swansea Point in Electoral Area E and is legally describe as Lot 1, Section 11, Township 21, Range 8, West of the 6th Meridian, Kamloops Division Yale District, Plan 11368. The property is particularly shown on the location map below:

The applicants have applied to amend Lakes Zoning Bylaw Number 900 to recognize the existing fixed dock associated with 673 Swanbeach Road. Fixed docks are not permitted in the Foreshore Residential (FR1) Zone. This dock is not currently sited in compliance with the required setbacks and has a larger upward surface area and wider walkway width than what is permitted in the FR1 Zone.

Waiving of Public Hearing

Section 464(2) of the Local Government Act provides an option for local governments to waive the holding of a public hearing with respect to a bylaw amendment, if there is an Official Community Plan (OCP) in effect for the area that is subject to the zoning bylaw, and the proposed bylaw amendment is consistent with the OCP. This area currently does not have an OCP, however in this instance the existing Electoral Area E Rural Land Use Bylaw Number 2000 is considered as similar to an OCP inclusive of its land use policies.

The public hearing for this bylaw amendment was waived by the CSRD Board at the December 10, 2020 Board Meeting, as the proposal is consistent with the policies in Bylaw Number 2000.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw Number 4001, all owners of property within 100 m of the subject property must be sent notices advising that a public hearing has been waived and be given the opportunity to provide comment about the bylaw amendment

How can I find out more about this application?

A copy of the proposed permit application and relevant background documents may be inspected at the Columbia Shuswap Regional District (CSRD), 555 Harbourfront Drive NE, Salmon Arm, BC between the hours of 9 am and 4 pm, beginning Tuesday March 30, 2021 and ending Thursday, April 15, 2021. (Please note that CSRD office hours open to the public are subject to change depending upon Provincial Health Orders and recommendations.) The documents will also be available to view on the CSRD website starting on Friday, April 9, 2021 on the Meetings, Agendas, and Minutes page under the applicable meeting date.

How do I send a written submission?

Written submissions will be accepted at the CSRD until 12 pm on Wednesday, April 14, 2021. The Board of the CSRD considers the author's name and residential address relevant to the Board's consideration of this matter and should be included in your submission. The author's phone number and email address are not relevant to the Board's consideration of this matter and should not be included in the written submission. Written submissions received by the CSRD are subject to public disclosure and a copy may be provided to the applicant. Please clearly write "BL900-28" on your submission. Written submissions may be submitted to emailing CSRD Planning or to the address above.

Where and when will the application be considered by the Board?

The Board will be considering the proposed bylaw for third reading and adoption at the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 am on Thursday, April 15, 2021. Due to special provisions regarding COVID-19 granted by Provincial Ministerial Order on Gatherings and Events, the April 15, 2021 CSRD Board meeting will be taking place through the use of remote communications technology. There is no specific opportunity for the public to provide verbal or written submissions about this application at this meeting.
