What is Lakes Zoning Amendment Bylaw Number 900-32C (BL900-32C)?
The subject property is located at 6432 Sunnybrae-Canoe Point Road in the Canoe Point area of Electoral Area C and is more particularly shown in bold outline on the map.
The property owners are proposing to rezone the foreshore of the subject property to allow for a total of 11 docks and 11 private mooring buoys (one dock and private mooring buoy for each of the 11 shareholders). Of the 11 shares areas, 10 share areas are waterfront and are currently permitted to have a dock and private mooring buoy. If approved, the bylaw amendment will allow 1 additional dock and 1 additional buoy than what is currently permitted.
Waiving of Public Hearing
This bylaw amendment proposal is consistent with the policies contained in Electoral Area C Official Community Plan Bylaw Number 725. Section 464(2) of the Local Government Act provides an option for local governments to waive the holding of a public hearing with respect to a bylaw amendment, if there is an Official Community Plan (OCP) in effect for the area that is subject to the zoning bylaw, and the proposed bylaw amendment is consistent with the OCP. As this bylaw amendment is consistent with the OCP, the Board waived the holding of a public hearing for this bylaw amendment at its May 20, 2021, Board meeting.
In accordance with Section 8.1.1 of Development Services Procedures Bylaw Number 4001, all owners of property within 100 m of the subject property must be sent notices advising that a public hearing has been waived and be given the opportunity to provide comment about the bylaw amendment.
