What is Lakes Zoning Amendment Bylaw Number 900-33C (BL900-33C)?
The subject properties are a shared interest development that is water access only and located near Cinnamousun Narrows on Shuswap Lake as shown on the map:

The applicant would like to rezone a portion of the foreshore adjacent to share lots 15 to 17 from FG1 to FM1 to match the zoning for the rest of this shared interest development and allow for these three shares to each have the ability to install or replace a dock for access to this water access only property. Due to topographic constraints the proposed bylaw amendment also includes a special regulation specific to the subject properties which would allow the option of a fixed or floating dock.
Waiving of Public Hearing
This bylaw amendment proposal is consistent with the policies contained in Electoral Area C Official Community Plan Bylaw Number 725 regarding use of the foreshore.
Section 464(2) of the Local Government Act provides an option for local governments to waive the holding of a public hearing with respect to a bylaw amendment, if there is an Official Community Plan (OCP) in effect for the area that is subject to the zoning bylaw, and the proposed bylaw amendment is consistent with the OCP. As this bylaw amendment is consistent with the OCP, the Board waived the holding of a public hearing for this bylaw amendment at its September 23, 2021 Board meeting.
In accordance with Section 8.1.1 of Development Services Procedures Bylaw Number 4001, all owners of property within 100 metres of the subject property must be sent notices advising that a public hearing has been waived and be given the opportunity to provide comment about the bylaw amendment.
